Beartooth Aviation Law, PLLC was formed after Mark Tomicich retired as a Senior Attorney from the FAA Office of Chief Counsel in Washington, DC (retired 2024). 

As a Senior Attorney, Mark’s responsibilities included providing legal advice to FAA accident investigators and employees during on-site investigations, representing the FAA in litigation arising from aircraft accidents, and teaching at the Transportation Safety Institute’s (TSI) Advanced Aircraft Accident Investigation Course in Oklahoma City. Mark is currently an instructor at TSI.

In his 34 years with the FAA, Mark provided legal representation for the agency at dozens of on-site accident investigations and NTSB Public Hearings, including these major accidents:
United 585 in Colorado Springs,
USAir 405 at LaGuardia,
USAir 427 in Pittsburgh,
Delta 1288 in Pensacola,
TWA 800 near New York,
Korean Air 801 in Guam,
Continental Airlines 1404 at Denver,
Continental Express 3407 at Buffalo, NY,
US Airways 1549 ditching on the Hudson, and
Atlas Air 3591 into Trinity Bay near Houston.

Mark received his Bachelor of Science degree from Montana State University – Billings in 1986 and received his Juris Doctor degree from the University of New Hampshire Franklin Pierce Law Center in 1989.  His state bar memberships include Montana and Pennsylvania, and he is a member of the American Bar Association, the Lawyer-Pilots Bar Association, and the Aircraft Owners and Pilots Association.
 
Mark holds a Commercial Airplane Multi-Engine Land certificate with an instrument rating, and he has attended the basic and advanced Aircraft Accident Investigation courses at TSI, the National Test Pilot School, CAMI’s Aerospace Physiology course, and has received Unusual Attitude Recovery training and Survival training.
